2005-06: The Detainee Treatment Act vs. the Military Commissions Act

John McCain, in December 2025, helps prohibit "military interrogators from using any techniques that weren't specifically approved in the US Army Field Manual, even if ordered to do so by the president"

this ends up codified in the Detainee Treatment Act

however, "Bush administration lawyers [...] issued further secret legal opinions undermining its provisions" (see especially John Yoo's legal memos, later withdrawn in the Obama administration)

and in 2006, Dick Cheney "spearheaded the drafting and passagge of the Military Commissions Act," which undoes much of the Detainee Treatment Act as well as the consequences of a Supreme Court ruling in June 2006 that "the Bush administration was in fact bound by the requirements of the Geneva Conventions"
